Agreement to these terms
By downloading, accessing, creating an account for, submitting content to, or using BidGeo, you agree to these Terms of Use and the Privacy Policy. If you do not agree, do not use the Service.
You must be legally able to enter into this agreement and must provide accurate information. If you use BidGeo for an organization, you represent that you are authorized to accept these terms for that organization.
The BidGeo service
BidGeo provides a directory for discovering and publishing information about auctions, sales, markets, and similar events. The Service may include browsing, saved listings, Profiles, submissions, moderation, advertising, and paid promotions.
BidGeo is only a listing facilitator. We are not an auctioneer, broker, seller, buyer, payment processor, event organizer, venue operator, shipper, insurer, or agent for any listed person or event. We do not take part in third-party sales or transactions.
All sales, bids, payments, refunds, delivery arrangements, admissions, attendance, travel, communications, and disputes are solely between the relevant third parties. BidGeo is not responsible for anything that happens at sales or other listed events, including third-party conduct, transaction outcomes, item condition or authenticity, safety, legality, pricing, availability, cancellations, injuries, losses, or damage.
Accounts and acceptable use
Keep your account credentials confidential and notify us promptly if you believe your account has been accessed without permission. You are responsible for activity taken through your account to the extent permitted by law.
You may not use the Service unlawfully; submit false, deceptive, infringing, defamatory, or harmful material; impersonate another person; interfere with the Service; attempt to bypass security or payment controls; collect data from the Service without permission; or use the Service to facilitate fraud, harassment, discrimination, or illegal transactions.
Listings, Profiles, and submitted content
You are responsible for the accuracy, completeness, legality, and timeliness of every Profile, listing, photo, link, document, ad, and other item you submit. You represent that you have all rights, permissions, and authority needed to submit it and to authorize BidGeo to host, reproduce, format, display, distribute, and promote it through the Service.
You retain ownership of your content, but grant BidGeo a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt for technical formatting, display, distribute, and store the content as needed to operate, improve, promote, protect, and moderate the Service. This license ends when the content is deleted from active systems, subject to reasonable backup, legal, security, and record-retention needs.
We may review, approve, reject, edit for clarity or formatting, limit, archive, remove, or suspend content, Profiles, listings, ads, and promotions at our discretion to protect the Service, comply with law, or enforce these terms. Review or publication does not mean BidGeo verifies, endorses, guarantees, or assumes responsibility for the content or event.
Profile subscription and one-time purchases
A Profile subscription is $9.99 per year in U.S. dollars, plus any applicable tax, unless a different price is displayed to you by the applicable store before purchase. The Profile subscription has no free trial or introductory free trial. It renews annually unless you cancel it through the store that sold it before the renewal date.
Paid advertisements and Feature Star purchases are consumable, one-time purchases. They are not subscriptions, do not create a transferable balance or recurring entitlement, and may be applied only to the identified listing or advertising request after purchase verification. A paid advertisement may remain subject to moderation. A store reversal or refund may result in removal of the related promotion or ad.
Apple's App Store or Google Play, as applicable, manages billing, payment methods, subscription renewal, cancellation, purchase history, and refunds. Store terms and policies govern those transactions. Requests for a refund must be made through the store that processed the purchase, except where applicable law requires otherwise. BidGeo cannot promise a store refund or change a store billing decision.
Third-party information and links
Listings and Profiles may contain information supplied by third parties or links to third-party websites. BidGeo does not control, investigate, endorse, or guarantee third-party information, websites, products, services, events, or people. Your use of third-party services is governed by the third party's terms and privacy practices.
Disclaimers and limits of liability
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, BidGeo disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and security. We do not promise that listings are current, complete, accurate, safe, lawful, available, or suitable for your needs.
To the fullest extent permitted by law, BidGeo and its owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, travel costs, personal injury, property damage, or losses arising from sales, events, listings, third parties, or your use of or inability to use the Service. Where liability cannot be excluded, it is limited to the greater of the amount you paid BidGeo for the Service in the 12 months before the claim or 100 U.S. dollars.
Indemnity, suspension, and termination
To the extent permitted by law, you will defend, indemnify, and hold harmless BidGeo and its owners, officers, employees, contractors, and service providers from claims, liabilities, damages, losses, and expenses arising from your content, your use of the Service, your violation of these terms, or your sale, event, or dealings with third parties.
We may suspend or terminate access to the Service, remove content, or cancel pending publication or promotion when we reasonably believe these terms, law, safety, security, or the integrity of the Service requires it. You may stop using the Service at any time and may request account deletion as described in the Privacy Policy.
Changes and contact
We may modify the Service or these Terms of Use. If we do, we will post the updated terms with a new effective date. Continued use after the effective date means you accept the revised terms to the extent permitted by law.
